涉外知產(chǎn)律師
主要職責
1. 案件管理：獨立處理從發(fā)起到解決的知識產(chǎn)權(quán)訴訟案件，包括起草提案，訴狀，申請，以及在中國法院和行政法庭的爭議證據(jù)收集。
2. 法律研究與策略：對知識產(chǎn)權(quán)法律、司法解釋、判例進行深入分析，制定有力的訴訟策略。
3. 法庭代理：在聽證、庭審和調(diào)解中代理客戶；與技術(shù)專家和證人合作。
4. 團隊協(xié)作：與同事和外部律師緊密合作，確保案件執(zhí)行的一致性。
5. 合規(guī)與趨勢：監(jiān)控中國知識產(chǎn)權(quán)立法、司法趨勢以及影響客戶投資組合的國際發(fā)展動態(tài)。

資格
?學歷：大學法律專業(yè)本科或碩士學歷；需要中國律師資格。
?基本要求：具備3-4年知識產(chǎn)權(quán)執(zhí)法與訴訟實務經(jīng)驗。
?資質(zhì)優(yōu)先：持有專利代理師資格證者，或擁有律師事務所、專業(yè)知識產(chǎn)權(quán)團隊工作經(jīng)驗者優(yōu)先。
?經(jīng)驗加分：具備處理跨境知識產(chǎn)權(quán)爭端經(jīng)驗者尤佳
?技術(shù)技能：
熟悉中國知識產(chǎn)權(quán)法律、行政程序和執(zhí)法機制。
較強的法律起草、研究和分析能力。
熟悉侵權(quán)和其他與知識產(chǎn)權(quán)相關(guān)的爭議解決活動。

Key Responsibilities
1. Case Management: Handle IP litigation cases independently from initiation to resolution, including drafting proposals, pleadings, motions, and evidence collection for disputes in PRC courts and administrative tribunals.
2. Legal Research & Strategy: Conduct in-depth analysis of IP laws, judicial interpretations, jurisprudences to develop robust litigation strategies.
3. Court Representation: Represent clients in hearings, trials, and mediations; collaborate with technical experts and witnesses.
4. Team Collaboration: Work closely with colleagues and external counsel to ensure cohesive case execution.
5. Compliance & Trends: Monitor updates in Chinese IP legislation, judicial trends, and international developments impacting client portfolios.
Qualifications
? Education: Bachelor’s or Master’s degree in Law from a top-tier university; PRC Bar qualification required.
? Experience: 3-4 years of IP enforcement/litigation experience, preferably in a law firm or specialized IP practice. Experience with cross-border disputes is a plus.Patent attorney license would be a plus
